CONTESTANT RULES & REGULATIONS WBPT-FM $500 SONG OF THE DAY CONDITIONAL PRIZE CONTEST April 14th – May 9th, 2008 (Monday through Friday only) There is no purchase necessary to enter or win the contest. Void where prohibited. 1. WBPT-FM will conduct the contest on weekdays during the above listed dates for a chance to win the following prizes: a. $500.00 for being caller #10 after hearing the specified song of the hour in designated hours. There will be a total of 20 prizes in the amount of $500.00. 2. WBPT-FM reserves the right to end the contest at any time without additional notice. 3. Contestants may win a maximum of one (1) time during the entire length of the promotion. A maximum of one (1) winner per household will be allowed for this entire promotion. Employees, associates, and interns of WBPT-FM, other related sponsors, and their immediate families may not participate and are not eligible to win. The term "immediate families" includes spouses, grandparents, parents, siblings, children, and grandchildren. 4. Each weekday during the promotional period, WBPT-FM will play a song of the day and listeners and/or website viewers at www.birminghamseagle.com will be instructed to call the station to participate in the contest at (205) 741-1069. 5. Once the song of the day starts playing, WBPT-FM will accept the 10th caller and that caller will become the official contestant for that individual game. 6. Once the official contestant has been selected, the station disc jockey then will ask the contestant what is the $500 song of the day. If caller #10 correctly identifies the song, they become the official winner of that contest. 7. Any winning contestant must be the participant who originally dialed the phone to the radio station to participate in the contest. No family members, friends, office associates, or any other person will be allowed to participate in the contest on another person's behalf. The contestant must provide their own name and own social security number. If a contestant uses a false name or social security number, they will be immediately disqualified from the contest and be ineligible to win any prize, and such conduct may be considered insurance fraud and may result in legal ramifications. 8. There will be a maximum of one (1) winner per prize. This contest and the prize values may be ended or altered at the sole discretion of WBPT-FM following the award of the prize. 9. The odds of winning the prize depend on the number of people attempting to participate in the contest at any given time. 10. In the event of a prize winning contestant of any monetary amount, the winning contestant will be required to submit sufficient identification in person including a valid driver's license 11. Prize winning contestants are subject to verification of their identity by WBPT-FM prior to their prize being awarded. Prize winning contestants may be required to submit to a polygraph test. A polygraph test which reveals any fraudulent activity or any non-compliance with any of the rules and regulations outlined herein will result in a grand prize claim denial. Prize winning contestants may also be required to submit to a voice analysis test to compare their voice to the grand prize winning contest call audio tape to verify an audio match. A voice analysis test that does not produce an audio match will disqualify the contestant and result in prize claim denial. 12. Persons who have won another contest or promotion of any kind from WBPT-FM within 60 calendar days before the contest date are ineligible to win. 13. Difficulties with phone lines to enter the contest or getting to WBPT-FM studios to claim prizes are not the responsibility of WBPT-FM. 14. As winner of the prize, you will be required to sign a WBPT-FM release form before your prize will be awarded. You will be responsible for all applicable title fees, registration fees, and taxes including state, local, and federal and therefore must present a valid Social Security Card and/or driver's license before claiming your prize. 15. As a prize winner, you acknowledge that WBPT-FM has the right to, without further authorization, publicize your name, character likeness, photograph, voice, and the fact that you are a prize winner for promotional purposes without financial remuneration. 16. There is no purchase necessary to enter or win the contest. Void where prohibited. 17. There will be no substitution for prizes. Participation in the contest and the prizes awarded are non-transferable. Failure to collect the prize within 30 business days of prize availability constitutes forfeiture of the prize. If forfeited, the prize will remain the property of WBPT-FM/Cox Radio Inc. Another winner will not be selected. 18. WBPT-FM reserves the right to make rule or contest changes without notice at any time. WBPT-FM also reserves the right to change the aforementioned contest dates without notice. 19. The decision of WBPT-FM management in the interpretation of these rules is final. By participating, persons agree to be bound by the decisions of the judges and the official rules. 20. If the winner is found in violation of the rules, he/she may be required to forfeit his/her prize. 21. WBPT-FM, its representatives, agencies and employees, are not responsible for any liabilities arising directly or indirectly from the award or use of the prize. 22. WBPT-FM, its representatives, agencies and employees, are not responsible for any changes or difficulties in travel or prize delivery. 23. WBPT-FM is not responsible for typographical, printing, or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
